Terms of Service

This is the agreement between GroomSpark and the grooming business using it. Creating an account or paying a subscription means accepting it.

Who you are contracting with

GroomSpark is a sole proprietorship operating in the State of Oregon, United States. “We” and “GroomSpark” mean that business. “You” means the grooming business holding the account. We will give you the owner's legal name on request — email hello@groomspark.com.

These terms cover grooming businesses. Pet parents booking an appointment are customers of the grooming business, not of GroomSpark, and their agreement is with that business.

What the service is

GroomSpark provides a hosted website for your grooming business, an online booking system, a client and pet database, appointment reminders by email and text message, and payment collection through Stripe. Features change over time; we may add, alter, or withdraw them. If we withdraw something you materially depend on, you may cancel and we will refund the unused part of the period you have paid for.

Your account

  • You must be 18 or older and operating a legitimate grooming business.
  • Keep your sign-in credentials secure. You are responsible for what happens under your account, including anything staff members you invite do.
  • The details you give us — business name, address, licensing — must be accurate. Some of them are passed to phone carriers and to Stripe, where inaccuracy causes rejection.

Trial, billing, and cancellation

New accounts start with a 14-day free trial. We collect payment details at signup but charge nothing during the trial.

When the trial ends the subscription begins automatically at the price shown to you at checkout, and renews monthly until cancelled. Businesses running more than one location are billed per location. Prices are in US dollars and exclude any applicable taxes.

  • Cancel during the trial and you are never charged.
  • Cancel later and the subscription runs to the end of the period you have already paid for, then stops. We do not refund a partial month unless the law requires it.
  • If a payment fails, we will retry and email you. Persistent failure suspends the account; your data is retained for 30 days after suspension so you can recover it.
  • If we change the price, we will give you at least 30 days' notice by email before it takes effect, and you may cancel instead.

Discounted rates offered to early customers apply for as long as the subscription remains continuously active. Cancelling and later re-subscribing means the then-current standard price.

Payments from your clients

Deposits and payments your clients make go through your own Stripe account, connected to GroomSpark. Money moves from your client to you. GroomSpark never holds your funds and is not a payment processor, a bank, or a money transmitter.

That makes several things yours: your agreement with Stripe and compliance with it, chargebacks and disputes, refunds to your clients, Stripe's processing fees, and the tax owed on your revenue. GroomSpark's subscription fee is separate from and additional to Stripe's fees.

Your content stays yours

Your business information, photos, service descriptions, client records, and booking history belong to you. You grant us only the permission needed to run the service: to store this material, display it on your site, and send it where you direct — for example, a reminder to a client.

Some website copy is drafted with AI assistance. You are responsible for reviewing anything published on your site, and you own the result. Uploading a photo means confirming you have the right to use it, including permission from anyone identifiable in it.

You can export your client and booking data at any time while the account is active. After cancellation we keep it for 30 days so you can retrieve it, then delete it.

Your clients' data

When your clients' personal information is in GroomSpark, you decide what is collected and why; we process it on your instructions. That means you are responsible for having a lawful basis to collect it, for collecting valid consent before any marketing message, and for responding to requests to see or delete it. We give you the tools — consent capture at booking, one-click unsubscribe, and a data-erasure function on every client record. Our privacy policy explains what those do.

Messaging rules

Text messaging is heavily regulated, and violations are expensive for both of us. You agree not to message anyone who has not consented, to honour every opt-out, to keep marketing messages within the hours the law permits, and never to import a purchased or scraped contact list.

We may suspend messaging on an account immediately if a carrier flags it or if we see evidence of these rules being broken. Phone carriers can also block or filter messages for reasons outside our control, so we cannot guarantee delivery.

Acceptable use

Do not use GroomSpark to:

  • Break the law, or publish content that is unlawful, deceptive, or infringing.
  • Attempt to reach another business's data, probe for vulnerabilities, or circumvent limits. Reporting a security issue in good faith is welcome and will never be treated as a violation.
  • Resell or white-label GroomSpark as your own product without a written agreement.
  • Place automated load on the service that degrades it for others.

Availability

We work to keep GroomSpark running and monitor it continuously, but we do not offer a contractual uptime guarantee, and the service is provided as is. There will be outages and maintenance. We will give notice of planned maintenance where we reasonably can.

Limits on liability

To the extent the law allows, neither party is liable for indirect or consequential losses — lost profits, lost bookings, lost goodwill — and our total liability arising from this agreement is capped at the amount you paid us in the twelve months before the claim.

Nothing here limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited. Some jurisdictions do not permit these limits, in which case they apply to you only as far as they are allowed.

Ending the agreement

You may cancel at any time from your billing settings. We may suspend or close an account for a serious breach of these terms, for non-payment, or where the law requires. Except in cases of abuse or legal compulsion we will give notice first and a chance to put things right.

On termination your site stops being served and admin access ends. Your data is retained for 30 days for export, then deleted, except records we are legally required to keep.

Changes to these terms

We may update these terms. Material changes will be emailed to account holders at least 30 days before taking effect, and continuing to use GroomSpark after that means accepting them. The date at the top always reflects the current version.

Governing law

This agreement is governed by the laws of the State of Oregon, United States, without regard to its conflict-of-laws rules. Disputes are subject to the exclusive jurisdiction of the state and federal courts located in Oregon.
